Legal and ethical constraints

A constraint is a limitation or a restriction on something to prevent something else to happening. In the Media industry, there are a lot of limitations, laws and restrictions.

Copyright applies to  work that is recorded in some way. Rights exist in items such as artistic, musical and dramatic work etc. It gives the author specific rights in relation to the work, prohibits unauthorised actions, and allows the author to take legal action against instances of infringement or plagiarism.

Intellectual property

Intellectual property refers to creations of the mind: literary and artistic works, symbols, names, images, and designs used in commerce.

IP is divided in two categories:
Industrial property which inventions, trademarks, industrial designs, and geographic indications of source.
Copyright which includes literary and artistic works such as novels, poems, films, musical artworks, artistic works such as paintings, drawings, photographs, sculptures and architectural designs.

Trademarks
A trademark is a sign capable of distinguishing the goods or services of one enterprise from those of other enterprises. At the national/regional level, trademark protection can be obtained through registration, by filing an application for registration with the national/regional trademark office and paying the required fees.Trademarks are protected by intellectual property rights. A trademark registration will confer an exclusive right to the use of the registered trademark. This implies that the trademark can be exclusively used by its owner, or licensed to another party for use in return for payment.
